Only two sections of the California Fire Code (CFC) are included in the Unified
Program. These are the Sections dealing with Hazardous Materials Management Plans and Hazardous Materials Inventory Statements,
which are the equicalent of Hazardous Materials Business Plans. In the current CFC, this is Section 8001.3.2 and 8001.3.3.
In the new edition of the CFC, which took effect January 1, 2008, the section number is 2701.5.1 and 2701.5.2.
State
law recognizes the need to ensure that first responders have the information they need to safely respond to emergencies as
well as the need to make providing this information as streamlined as possible. Therefore,
- Local fire agencies can require information
in addition to the state requirements for HMBP's be included in HMBP submittals.
- Local
fire agencies can require submission of a HMBP when the quantities present do not exceed the state HMBP thresholds but do
exceed CFC permit threshols, some of which are lower than the state levels.
- CUPAs
and PAs are required to provide HMBP's to local fire agencies within 15 days of receipt and conformation.
